The appeal hearing on an abatement order serves to provide a full opportunity to each person subject to an abatement order to object to the determination that a violation has occurred, that the violation continues to exist, that the remedy and Hearing Officer’s decision is final. In addition, the failure of any person who is subject to an abatement order to appear at the appeal hearing shall constitute a failure to exhaust administrative remedies.
