18-34 REPEAT APPLICATIONS.

a. When any application made pursuant to these regulations has been denied, no new application which is substantially the same shall be filed within one (1) year of the date of the previous denial unless the Planning Commission or City Council, for good cause, shall grant permission to do so. The Commission or Council shall initiate such application based on whether the project was denied by the Commission or Council. If the decision to deny an application reviewed by the Commission is finally determined on appeal by the Council, the Council shall grant permission.

b. The Director shall determine when an application is substantially the same as a previous application, subject to the appeal procedures of Article 18-36. (Ord. #248-2020, S2 (Exh. A))
