18-42 ABATEMENT OF PUBLIC NUISANCES CREATED BY CULTIVATION OF MARIJUANA IN VIOLATION OF ARTICLE 18-41.

The public official, upon receipt of information leading him/her to believe that a public nuisance, subject to this article, exists upon private property in any zone in the City, shall make a reasonable investigation of the facts and inspect the property to determine whether or not a public nuisance exists. Inspections may include photographing the conditions or obtaining samples or other physical evidence. If an owner, occupant or agent refuses permission to enter or inspect, the public official may seek an inspection warrant pursuant to the procedures provided for in the California Code of Civil Procedure Sections 1822.50 through 1822.59.
