2-4 CITY CLERK.

Pursuant to Government Code Section 40801 et seq., the duties of the City Clerk of the City of Clearlake shall be as follows:

a. To keep an accurate record of the proceedings of the City Council in books bearing appropriate titles and devoted exclusively to such purposes. The books shall have a comprehensive general index.

b. To keep a book marked “Ordinances” and record in it all City ordinances with a certificate annexed to each, stating that it has been published or posted pursuant to law, stating that the file copy is a true and correct copy of the ordinance.

Editor’s Note: Resolution No. 87-78, adopted September 21, 1987 designates the Clear Lake Observer for legal publications as required by the City of Clearlake.

c. To be the custodian of the City seal.

The City Clerk will also:

d. Maintain custody of all City records not otherwise provided for by ordinance or resolution, and provide certified copies upon request and payment of any fee prescribed by such service.

e. Generally, act as Secretary to the City Council and perform all duties as are customarily understood to pertain to the office of a secretary, including but not limited to:

1. Receiving all correspondence addressed to the Council.

2. Preparing the agenda of all Council meetings.

3. Giving all notices of meetings or hearing as required by law.

f. Accept all legal process (summonses, subpoenas, claims and demands) for the City.

g. File all official bonds required of City offices, employees, franchises, or licensees, except as may be otherwise provided for by statute, ordinance, or resolution.

h. Administer oaths, affirmations, and acknowledgements.

i. Receive petitions relating to City matters.

j. Perform all duties relating to annexation, improvement districts, street vacations, changes of street names or numbers, and related and similar matters as required by State law.

k. Any other duties as may now be prescribed by State law or as may hereafter be prescribed by State law except as set forth in the following paragraph.

l. The office of Director of Finance is separate from the Office of City Clerk although the same person may hold both offices at the same time. The duties of a Director of Finance shall be separate from the duties of the Clerk and will be compensated separately. (Ord. #9, SS1, 2)
