21-3 DEFINITIONS.

For purposes of this Chapter, the following words and phrases shall be interpreted as follows:

AQUATIC PLANT: Any plant including a floating, emergent, submersed, or ditchbank species growing in, or closely associated with, an aquatic environment, and includes any part or seed of such plant.

CITY COUNCIL: The City Council for the City of Clearlake or its duly appointed agent(s).

DEPARTMENT: The Lake County Department of Agriculture.

GIFT: Any aquatic plant that is freely given or bestowed from one person to another.

NON-NATIVE, INVASIVE AQUATIC PLANT: Aquatic plants that have been identified as being not native to Lake County and exhibit the characteristics of invasive growth pattern(s). For the purpose of this Chapter, the following plants of concern are identified as non-native, invasive aquatic plants:

a. Hydrilla (Hydrilla verticillata)

b. Spatter Dock or Yellow Pondlily (Nuphar polysepala)

c. Water Hyicanth (Eichornia crassipes)

d. Purple Loosestrife (Lythrum salicaria)

e. Giant Salvinia (Salvinia molesta)

f. Eurasian watermilfoil (Myriophyllum spicatum)

g. South American Spongeplant/Frogbit (Limnobium laevigatum)

h. Parrotfeather (Myriophyllum aquaticum)

i. Brazilian waterweed (Egeria densa)

PERSON: Any person, firm, joint venture, joint stock company, corporation, partnership, association, club, company, business trust, organization, or the manager, lessee, agent, servant, officer or employee of any of them.

FOR SALE: The action of attempting to sell.

SELL: Include, in any of its variant forms, to offer for sale, keep for sale, expose for sale, barter, exchange, trade, rent, transfer of ownership or control, or lease.

UNVIABLE: Incapable of sprouting, developing, growing, or reproducing; non-viable. (Ord. #2007-128)
