As used in this Chapter:

ANIMAL shall mean any live, vertebrate creature, domestic or wild, except for fish.

ANIMAL SHELTER shall mean any facility operated by a humane society, or municipal agency, or its authorized agents for the purpose of impounding or caring for animals held under the authority of this Chapter or state law.

AT LARGE shall mean so free from restraint as to be liable to do or cause mischief.

CAT shall mean a domestic cat (Felis Catus).

CAT CAREGIVER shall mean a person who maintains a homeless cat or cat colony, as the case may be, subject to a cat colony permit and in accordance with established professional standards approved by the Director of Animal Care and Control, that include, but are not limited to, spaying/neutering, vaccination and feeding. Such person shall be presumed to be the cat owner for purposes of this Chapter.

CAT COLONY means one (1) or more homeless cats over four (4) months of age who establish, inhabit and control a territory in common, but which are maintained by a cat caregiver.

COMMERCIAL ANIMAL ESTABLISHMENT shall mean any pet shop, grooming shop, auction, riding school or stable, zoological park, circus, performing animal exhibition, or kennel.

FERAL CAT shall mean a domestic cat that lives in a wild state and cannot be socialized.

GROOMING SHOP shall mean a commercial establishment where animals are bathed, clipped, plucked, or otherwise groomed.

HOMELESS CAT shall mean a domestic cat that has been abandoned by its owner, strayed from its, owner, or is born feral.

KENNEL shall mean any premises wherein any person engages in the business of boarding, breeding, buying, letting for hire, training for a fee, or selling dogs or cats, or any lot, building, structure, enclosure or premises whereupon five (5) or more dogs over the age of four (4) months are kept, whether in special buildings or runways or not.

LAWFUL FENCE shall mean any fence which is strong, substantial and sufficient to prevent the ingress and egress of the animals it is meant to contain within its boundaries.

OWNER shall mean any person, partnership, or corporation owning, keeping, or harboring one or more animals. An animal shall be deemed to be harbored if it is fed or sheltered for three consecutive days or more.

PET shall mean any animal kept for pleasure rather than utility.

PET SHOP shall mean any person, partnership, or corporation, whether operated separately or in connection with another business enterprise except for a licensed kennel, that buys, sells, or boards any species of animal.

PROPER CARE shall mean:

a. The provision of food that is free from contamination, and of sufficient quality and nutritive value to meet the known normal daily requirements for the condition and size of the animal.

b. The provision of watering receptacles which are kept clean and have fresh water provided at all times.

c. The removal of excreta from the primary enclosures at least once daily, or as often as necessary to prevent contamination of the animals contained therein and to reduce disease hazards and odors.

d. The maintenance of premises in a clean condition and in good repair in order to protect the animals from injury.

RESTRAINT shall mean any animal secured by a leash or within the property limits of its owner.

RIDING SCHOOL or STABLE shall mean any place which has available for hire, boarding and/or riding instruction, any horse, pony, donkey, mule or burro.

VETERINARY HOSPITAL shall mean any establishment maintained and operated by a licensed veterinarian for surgery, diagnosis and treatment of diseases and injuries of animals.

VICIOUS ANIMAL shall mean any animal or animals that constitute a physical threat to human beings or other animals.

WILD ANIMAL shall mean any live monkey (non-human primate), raccoon, skunk, fox, poisonous snake, leopard, panther, tiger, lion, lynx, or any other warmblooded animal which can normally be found in the wild state.
